Session Recording Terms and Conditions

These Session Recording Terms & Conditions (“Agreement”) form a legally binding contract between Lumi Learning (“Organization”) and the parent or legal guardian (“Parent/Guardian”) of the student named in the booking form (“Student”). By checking the consent box during booking, the Parent/Guardian acknowledges, understands, and agrees to the following:

1. Consent to Record
By checking the consent box, the Parent/Guardian grants explicit permission for Lumi Learning to record tutoring sessions, which may capture the Student’s voice, likeness, and interactions.
Checking the box constitutes the Parent/Guardian’s electronic signature, legally enforceable under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law.

2. Purpose of Recordings
Recordings are provided as an optional service for:

Ensuring the safety and well-being of the Student during online sessions;

Allowing parents to confirm that sessions are professional, respectful, and appropriate;

Providing families with peace of mind and accountability; and
-
Offering students the ability to review material privately, if desired.
Recordings are not required for tutoring and are never used for marketing, advertising, or training purposes.

3. Privacy and Security Commitment
Lumi Learning treats student safety and confidentiality with the highest priority. Accordingly:

Recordings are stored securely and delivered only to the Parent/Guardian.

Access is restricted to Organization leadership; tutors and contractors do not have access.

Recordings will never be made public, sold, or disclosed to third parties unless required by law.

Delivery is made through a private, restricted Google Drive link accessible only to the Parent/Guardian’s email address.

Links may be time-limited and access may be revoked once the recording is deleted.

4. Access and Delivery

Recordings will be delivered to the Parent/Guardian within seven (7) business days of the session.

Delivery is typically made via a secure Google Drive link, with access restricted to the Parent/Guardian.

While recordings are almost always successfully captured, rare technical issues may prevent recording. In such cases, the Organization will promptly notify the Parent/Guardian.

5. Retention and Deletion

Recordings are retained for no longer than sixty (60) calendar days from the date of the session.

After this period, recordings are permanently and irreversibly deleted from Lumi Learning’s systems, and any access links are disabled.

Parent/Guardian may request earlier deletion at any time in writing.

6. Parent/Guardian Rights and Restrictions

Parent/Guardian may use the recordings solely for private, family, and educational purposes.

Recordings may not be copied, reposted, or distributed outside the household.

By consenting, the Parent/Guardian acknowledges that recordings are a protective safeguard and are managed under Lumi Learning’s privacy and safety practices.

7. Reliability and Limitation of Liability

Lumi Learning strives to provide dependable recordings as a measure of safety and transparency.

Parent/Guardian acknowledges that occasional technical failures may occur and releases the Organization from liability for missing or incomplete recordings.

The Organization’s liability, if any, is limited to the amount paid for the recording service.

8. Governing Law and Entire Agreement
This Agreement is governed by the laws of the State of Illinois, with jurisdiction in Cook County, Illinois, unless otherwise required by law.
This Agreement constitutes the entire understanding between the Parent/Guardian and Lumi Learning regarding session recordings and supersedes all prior oral or written communications.

9. Acknowledgment
By checking the consent box on the booking form, the Parent/Guardian affirms that they have read, understood, and agreed to these legally binding Terms & Conditions, and acknowledges Lumi Learning’s commitment to student safety, professionalism, privacy, and accountability.
